Terms of Use

1. Purpose

Pilotd is a SaaS (Software as a Service) platform for freelance mission tracking. These Terms of Use (hereinafter "Terms") govern the use of the service accessible at pilotd.fr.

By creating an account or using the service, you accept these Terms without reservation. If you do not agree to these Terms, please do not use the service.

2. Definitions

  • Service: the Pilotd platform, including the website, the progressive web application (PWA), and all associated features.
  • User: any natural or legal person registered on the platform with an account.
  • Tenant: an isolated workspace created by a user, in which data is segregated.
  • Content: all data entered by the user, including but not limited to: clients, missions, invoices, quotes, time entries, documents, and settings.

3. Access to the Service

Registration is free and provides access to a basic plan. Paid plans offering additional features are available through subscription.

The service is reserved for individuals aged 18 or older acting in a professional capacity. Account creation requires a valid email address and a password.

The publisher reserves the right to suspend or terminate access to the service for any user who fails to comply with these Terms, without prior notice or compensation.

4. User Account

The user is solely responsible for maintaining the confidentiality of their login credentials (email address and password). Users must not share their credentials with third parties.

A user may join multiple workspaces (tenants) through the invitation system. Within each tenant, their rights are defined by the permissions assigned by the administrator.

All activity performed from an account is deemed to have been carried out by the account holder. Users must immediately notify the publisher of any unauthorized use of their account at contact@pilotd.fr.

5. Use of the Service

Users agree to use the service in compliance with applicable law and these Terms. The following activities are strictly prohibited:

  • Scraping, automated data extraction, or any abusive use of the service's APIs.
  • Attempting to reverse-engineer, decompile, or disassemble the software.
  • Storing illegal, defamatory, infringing, or otherwise harmful content.
  • Attempting unauthorized access to other users' data or to the service's infrastructure.
  • Using the service for spam, phishing, or distributing malware.

The publisher reserves the right to remove any content that violates these Terms and to suspend the relevant account.

6. Intellectual Property

The Pilotd platform, including its source code, design, brand, logos, and documentation, is the exclusive property of the publisher. Any unauthorized reproduction, modification, or distribution is strictly prohibited.

Users retain full intellectual property rights over the content they enter into the service. The publisher acquires no rights over this data, except for a limited license necessary to provide the service (hosting, display, backup).

7. Personal Data

The processing of personal data collected through the service is described in our Privacy Policy.

The publisher is committed to processing personal data in accordance with the General Data Protection Regulation (GDPR) and applicable French data protection legislation.

8. Liability

The service is provided "as is" and "as available." The publisher uses reasonable efforts to ensure the availability and security of the service but does not guarantee uninterrupted availability or the total absence of errors.

Under no circumstances shall the publisher's liability exceed the total amount paid by the user during the twelve (12) months preceding the event giving rise to the claim.

The publisher shall not be held liable in cases of force majeure, including but not limited to: natural disasters, network outages, hosting provider failures, or government decisions.

9. Changes to the Terms

The publisher reserves the right to modify these Terms at any time. Changes will take effect thirty (30) days after publication on the website.

Users will be notified of any material changes by email sent to the address associated with their account. Continued use of the service after the new terms take effect constitutes acceptance of those terms.

10. Termination

Users may delete their account at any time from their profile settings. It is recommended to export data before deletion.

After account deletion, user data is retained for thirty (30) days to allow for potential reactivation. After this period, data is permanently deleted from our systems, except where retention is required by law.

The publisher may also terminate an account in the event of a breach of these Terms, subject to reasonable notice unless the breach is serious.

11. Governing Law

These Terms are governed by French law. Any dispute relating to the interpretation, performance, or termination of these Terms shall be submitted to the competent courts of Paris, France.

In the event of a dispute, the parties agree to seek an amicable resolution before referring the matter to the competent courts.
